Welcome to Tale of the Tape Maker. By accessing or using our AI fight poster generator service (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, purchasing credits, or using any part of the Service, you confirm that you are at least 13 years old and agree to these Terms and our Privacy Policy.
2. Description of Service
Tale of the Tape Maker is an AI-powered tool that generates fight comparison graphics and promotional posters based on user-provided photos, stats, and style selections. Output is generated by third-party AI models and results may vary.
3. Credits and Payment
The Service operates on a credit system. Each operation (generation, refine, upscale) costs a set number of credits depending on resolution and type. Credits may be purchased as one-time packs (never expire) or as monthly subscription plans (credits reset each billing cycle and do not roll over). All payments are processed through Stripe. All purchases are final and non-refundable except where required by law.
4. User Content and License
You retain ownership of the photos and text you upload ("User Content"). By uploading content, you grant us a limited, worldwide, non-exclusive license to process, transmit, and temporarily store it solely for the purpose of providing the Service. You represent that you have all rights necessary to upload and use the content, and that the content does not infringe any third-party rights.
5. Generated Output
You own the images generated by the Service from your input, subject to these Terms and applicable AI model provider terms. You are responsible for how you use generated images, including ensuring you have rights to any likenesses depicted. We make no guarantee of uniqueness, accuracy, or suitability for any particular purpose.
6. Prohibited Use
You agree not to use the Service to: (a) upload photos of people without their consent; (b) generate content that is illegal, defamatory, harassing, or infringes intellectual property; (c) impersonate others; (d) generate sexual, violent, or hateful content involving real people; (e) attempt to reverse engineer or abuse the Service; (f) resell credits or access without permission.
7. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability, specific output quality, or that generated images will match template samples. AI outputs are inherently variable.
8. Limitation of Liability
To the maximum extent permitted by law, Tale of the Tape Maker and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the three months preceding the claim.
9. Termination
We may suspend or terminate your access at any time for violation of these Terms. You may stop using the Service at any time. Unused subscription credits are forfeited upon cancellation.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via the Service or email.
11. Returns & Refunds
All sales of physical products are final. We do not accept returns or exchanges except for items that arrive damaged or defective. If you receive a defective item, please contact us within 14 days of delivery with photos of the issue. Refunds for digital credits are not available once credits have been used.
12. Image Rights & Ownership
Images generated through our Service are created using AI technology. You retain rights to use the generated images for personal and commercial purposes, subject to applicable laws. We do not claim ownership of your generated content. However, we reserve the right to use anonymized, aggregated data for service improvement.
13. Likeness & Publicity Rights
You are solely responsible for ensuring you have the necessary rights and permissions to use any likeness, name, or image of any individual in your generated content. We are not responsible for any claims arising from your use of third-party likenesses. By using our Service, you represent and warrant that you have obtained all necessary consents.
14. DMCA & Copyright Claims
We respect intellectual property rights. If you believe content on our platform infringes your copyright, please submit a DMCA notice through our contact form. Include: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, (4) a statement of good faith belief, and (5) a statement of accuracy under penalty of perjury.
15. Account Deletion
You may delete your account at any time through the Account settings page. Upon deletion, all your personal data, generated images, order history, and remaining credits will be permanently removed. Active subscriptions will be canceled. This action cannot be undone. We may retain certain data as required by law or for legitimate business purposes.
